WHAT IS PUBLIC INTOXICATION IN TEXAS?

Under Texas Penal Code §49.02, Public Intoxication occurs when a person appears in a public place while intoxicated to the degree they may endanger themselves or others.

Public Intoxication is often thought to just be a ticket. It’s not. Public Intoxication is a Class C criminal misdemeanor in Texas. Simply paying the fine results in a conviction that creates a permanent criminal record.

WHAT ARE THE PENALTIES FOR PUBLIC INTOXICATION IN FORT WORTH?

The three main penalties for Public Intoxication in Fort Worth are:

  • Fine up to $500
  • Court ordered classes
  • Community service

The fine, community service, and classes are not a big deal. The permanent criminal conviction you get from pleading guilty is a big deal. It stays on the record permanently – closing the door to future expungement.

The conviction can be used against you in future criminal prosecutions, and contextually in other, unrelated legal proceedings like divorce and child custody matters. Criminal records are public records.

CAN YOU GET A PUBLIC INTOXICATION DISMISSED IN FORT WORTH?

Yes. Hiring a Fort Worth Public Intoxication lawyer to request and review the evidence often reveals basic, procedural issues that can lead to dismissal. Public Intoxication is entirely subjective, leaving the door open to challenges for experienced attorneys. Common issues are:

  • Video evidence contradicts police report
  • The person was not a danger to themselves or others
  • Constitutional rights were violated

Public Intoxication charges in Fort Worth can also be dismissed through negotiation. Some people accused of Public Intoxication were publicly intoxicated, and really were a danger to themselves or others. Things happen – but one bad moment shouldn’t color your criminal record forever.

Trey Porter Law has significant experience securing dismissals in even the most aggravated intoxication cases, closing the matter effectively and with discretion, while preserving expunction eligibility.
