WHAT IS AN EXPUNCTION IN TEXAS?

An expunction is a legal process under Texas Code of Criminal Procedure, Chapter 55 that orders courts, police, and state agencies to destroy or return all records of an arrest. WHAT CRIMES CAN BE EXPUNGED IN TEXAS?

Eligibility depends on the outcome of the case. When determining what crimes can be expunged in Texas, the case outcome is the most important factor. Most crimes can be expunged if:

  • Charges were dismissed
  • Charges were never filed
  • The case resulted in acquittal
  • The arrest ended with a qualifying deferred outcome
